Polen -Rechtsstaat in Gefahr?

Summary:
As the government and the parliamentary majority still does not appear to be willing to follow the decisions of the Constitutional Tribunal, is anticipated a tangible constitutional crisis. This is particularly to be expected when the previous discussion on the role of the Constitutional Tribunal in the future with the dispute over the constitutionality of recent interventions in the organization of public service broadcasting by the so-called small media law and by the planned for spring combines comprehensive interventions in the freedom of the media, namely when the Constitutional Tribunal these legislative acts – as is expected – declared unconstitutional.
The European Union can not and must not tolerate such a development in Poland. It is therefore necessary to work through clearly that Poland Państwo Prawa, the rule of law remains.

 Zusammenfassung: Die Grundrichtung des Nachbarschaftsvertrages, seine wichtigste „Botschaft” an uns alle wird auch in Zukunft weiterhin gelten: Polen und Deutsche sind und bleiben Nachbarn in Europa und unsere gemeinsame Aufgabe und Verantwortung besteht darin, in Eintracht miteinander, d.h. nicht „gegeneinander” und nicht „nebeneinander”(!) zu leben.

Dies mag wie eine Binsenweisheit klingen, aber eins dürfen wir nicht vergessen: wir, Europäer aus Polen oder Deutschland werden heute mit den schwierigsten politischen und wirtschaftlichen Herausforderungen unserer Zeit konfrontiert: Finanzkrise in der Euro-Zone, Terroranschläge, aggressive Politik Russlands, massive Migrationsströme und dazu noch – nach dem Motto „ein Unglück kommt selten alleine!” – der Brexit.

Summary: The basic direction of the Neighborhood Treaty, its most important „message“ to us all, will continue to apply in the future: Poland and Germans are and remain neighbors in Europe and our common task and responsibility is to work together in harmony with each other, Not „against each other“ and not „side by side“.

This may sound like a rarity, but one thing we must remember is that we Europeans from Poland or Germany are faced today with the most difficult political and economic challenges of our time: financial crisis in the euro zone, terrorist attacks, aggressive politics of Russia, massive migratory flows and In addition – according to the motto „a misfortune rarely comes alone!“ – the Brexit.

Das Konzept der Lean Production und des Lean Management in der Zeit der Globalisierung

 Zusammenfassung:  Das Ziel des vorliegenden Artikels ist die Darstellung der zentralen Gedanken des Lean Management Konzeptes, verschiedener Arten des Unternehmensmanagements und der Möglichkeiten, die behandelten Methoden zur Optimierung des Managements im Unternehmen anzuwenden. Im Artikel wurden Übersichtsdarstellungen der zugänglichen Literatur, Studien und Berichte aus dem Managementbereich genutzt.

Summary:  The purpose of this article is to show the essence of Lean Management, management practices applied by companies, and the possibility for this method to be used to further improve management in an organisation. This article uses a review of existing literature, studies and reports relating to management.

Sozial-kulturelle Tätigkeit der jüdischen Gemeinde in Berlin in den Jahren 1990-2004 Rechtsanwältin, Spezialistin in Bereich Bevölkerung der jüdischen Abstammung in Berlin. E-Mail: boreczek1@yahoo.de. StreszczenieW analizowanym okresie Gmina Żydowska w Berlinie, przede wszystkim dzięki znaczącej pomocy ze strony państwa niemieckiego, miała możliwość realizować swoje zadania na rzecz społeczności żydowskiej. Sprawna działalność społeczno- religijna Gminy wymagała jednak ustalenia wspólnych priorytetów i dążeń, w tym zwłaszcza jasnej i klarownej misji, wspólnych postaw i poglądów, form aktywności (działania, przedsięwzięcia, zwyczaje, rytuały), a przede wszystkim – świadomości istnienia wspólnoty. Można zauważyć, że problemem w berlińskim środowisku żydowskim były antagonizmy i przeciwstawianie się sobie różnych opcji, głównie grup mniej i bardziej religijnych, niemiecko i rosyjskojęzycznych. Żydowskie zjednoczenie po 1990 roku, jak i integracja społeczności żydowskiej w skali ogólnoniemieckiej  były procesem bardzo trudnym, ale trzeba stwierdzić, że w analizowanym okresie w Niemczech i w Berlinie powstała nowa społeczność żydowska. Trudno arbitralnie zdefiniować jaki uzyskała ona kształt, pewne było natomiast to, że nowa społeczność żydowska, bez wątpienia różniła się od tej stworzonej przez Żydów, mieszkańców Niemiec sprzed 1933 roku, a jej trzon stanowili rosyjscy imigranci żydowscy.Z pewnością także społeczność żydowska Berlina uzyskała wymiar europejski i należy na nią spoglądać w szerokim, międzynarodowym kontekście. Słowa kluczowe: Gmina żydowska, Berlin, społeczeństwo żydowskie, kultura i integracja społeczności żydowskiej. Summary  Revival of Jewish communities in Germany after World War II is considered to be a historical phenomenon. The communities have become a significant part of social and political reality in Germany. Today, Jewish community in Germany is the third largest in Western Europe. In 2004, there were 106,000 members of Jewish communities in Germany, including ca. 12,000 members registered in the Jewish Community of Berlin.Berlin is not only a symbol of post-war history of Germany, but also a long acknowledged centre of Jewish life.

Because of poor flow of people of Jewish origin to post-war Berlin, their high death rate, and most of all heavy migration to Israel, quantitative size of the whole Jewish community in Berlin remained at the same level for more than 40 years.

The situation changed at the beginning of the 90’s when the Jewish community began to expand rapidly. The main reason for such a status quo was the collapse of the Soviet Union followed by opening of the borders for Soviet immigrants of Jewish origin, and the Reunification of Germany, Berlin and Jewish community of the city.The revival of Jewish life in Germany was demonstrated mainly by quantitative changes. The number of members of the Community tripled, part of them were younger and simultaneously it started to develop dynamically. At the same time, the representatives of the Community faced a serious challenge of integrating the immigrants, who formed the majority, into the Community’s minority composed of lingered members.

Indeed, the dominance of Soviet-Jewish members of the Community brought about many changes. Well known Jewish world of Western Europe irrevocably came to an end. Cultural programme of the Community, which was also outlined by the immigrants, resembled “Russian folklore”. The management of the Community was very different from traditional methods accepted by German Jews. The Community was divided into two realities: Russian one and German one.

In 1990-2004 Jewish religious life was marked by pluralism. An increase in the number of new, independent of the Community, liberal and orthodox Jewish communities was a direct consequence of discontent of the Community’s members with its effectiveness and insufficient openness. A dispute between the Community’s representatives and representatives of other factions of Judaism related not only to tradition and identity, but also spheres of influence and authority.The number of secular Jewish initiatives increased, particularly on the outskirts of the Community, but also outside it. In Germany, a number of museums, centres and institutions dealing with Jewish issues were established, and many cultural and social projects were launched to fight against anti-Semitism. Initiatives were announced, both Jewish and non-Jewish, to lay foundation for German-Jewish dialogue, and for cooperation between those two communities. The process resulted from revival of “Jewishness”, or even “fashion” for it in German society.For Germans, the presence of Jewish social and cultural institutions, as well as their contribution to German political scene, proved a remarkable success and provided Jews with a privileged position in Germany. In return however, the presence of Jews was to be a stabilizing phenomenon and a litmus test for German democracy, and paved the way for new image of German lawfulness and morality. Thus, Jewish community played an instrumental part in a new chapter of German history. In the analysed period the Jewish Community of Berlin was able to pursue its objectives that aimed to support Jewish community, mainly due to substantial assistance from the German state. Effective socio-religious activity of the Community required, though, to set common priorities and aspirations, including clear and comprehensible mission, shared attitudes and opinions, forms of activity (operations, endeavours, customs and rituals) and most of all – awareness of the community. It may be noted that problems in Jewish community of Berlin were antagonisms and opposition between different factions, particularly those more and less religious, as well as between German and Russian speaking groups.Jewish unification after 1990, as well as integration of Jewish community on a nationwide scale in Germany were very difficult processes; however, it should be noted that, at that time, there was a new Jewish community coming into being in Germany and in Berlin. It is difficult to arbitrarily define what form it took, but it was certain that the new Jewish community was undoubtedly different from the one established by Jewish residents in Germany before 1990, and its backbone were Soviet immigrants of Jewish origin.It is certain as well that Jewish community of Berlin acquired a European dimension and should be approached in a broad, international context. Über das Verhältnis von Diagnose und Prognose zu statischen und dynamischen Merkmalen einer Straftat

 Zusammenfassung

Dieser Artikel besteht aus drei Teilen. Im ersten Teil wurden Betrachtungen zur Charakteristik der Termine Diagnose und Prognose als Resultate des Diagnose- und Prognoseprozesses angestellt. Der weitere Teil der Monographie wurde der Analyse der Konstruktion des modifizierten Straftattyps in der qualifizierten Variante gewidmet. Es wurde auch auf die Möglichkeit der Realisierung des Qualifikationsprozesses der Straftat sowohl mit Hilfe statischer Umstände (die schon während des Begehens der Straftat vorkommen), als auch qualifizierender Folgen, die einen dynamischen Charakter haben, hingewiesen. Im letzten Teil des Artikels wird erörtert, welche Rolle der Diagnose- und Prognoseprozess bezüglich der qualifizierenden Merkmale mit statischem (Umstände) und dynamischem Charakter (Folgen) spielt und welche Modifikationen auf der Diagnostik- und Prognoseebene hinsichtlich des qualifizierten Typs der Straftat auftreten können.

Summary:

This article consists of three parts. In the first part of the considerations for the characteristic appointments diagnosis and prognosis were made as a result of the diagnosis and prognosis process. The second part is dedicated to the analysis of the construction of the modified offense type in the eligible variant. There was also the possibility of realizing the qualification process of the crime both by static matters (which occur already during the commission of the offense), as well as qualifying consequences that have a dynamic, pointed. In the last part of the article is considered the role of diagnosis and prognosis process with respect to the qualifying characteristics with static (Affairs) plays and dynamic character (episodes) and what modifications to the diagnosis and prognosis level may occur with respect to the eligible type of offense.

,,Drug-related crime in Poland –history, current situation and forecasts’’

This article outlines how drug addiction and drug-related crime in Poland have changed since the beginning of the 20th century up to date. The paper also presents the basic characteristics of the current so-called “market period” of drug addiction. The article characterises the foundations of the existing Polish legal regulations concerning prevention and combating drug addiction and reviews the arguments for and against the method of criminalisation and penalisation of possessing small amounts of drugs for personal use.

Zusammenfassung:

,,Die Drogenkriminalität in Polen – Geschichte, Gegenwart und Zukunftsprognose’’

Der Artikel stellt den Umriss des Wandels der Erscheinung der Drogensucht und der Drogenkriminalität in Polen dar, vom Anfang des 20. Jahrhunderts bis heute. Im Text wird es auf Grundzüge des sogenannten ,,Marktzeitraums’’ hingewiesen, in dem sich Rauschgiftsucht zur Zeit befindet. Der Artikel enthält auch Charakteristik der Hauptgrundsätze der bisherigen polnischen Rechtsregelungen, die die Vorbeugung und Entgegenwirkung der Drogensucht betreffen sowie eine Übersicht der Argumente, welche für oder gegen Kriminalisierung und Strafbarkeit einer geringen Menge von Drogen für den Eigengebrauch sprechen.

Europejski nakaz aresztowania jako instytucja prawa wspólnotowego – wybrane problemy implementacji i zastosowania w Niemczech

Streszczenie

Artykuł ten przedstawia rzetelną analizę przepisów ustawy o międzynarodowej pomocy prawnej w sprawach karnych, a także przyczyn i skutków jej dwóch nowelizacji dokonanych w wyniku konieczności implementacji decyzji ramowej o Europejskim Nakazie Aresztowania. Autor przedstawia również uzasadnienie i konsekwencje wyroku Federalnego Trybunału Konstytucyjnego, dotyczącego wydawania obywateli niemieckich do innych państw członkowskich Unii Europejskiej.

Autor oferuje praktyczne spojrzenie na przyczyny odmowy wykonania ENA od strony niemieckich przepisów i ich interpretacji w praktyce, np. wyjaśniając, że przyczyną odmowy realizacji zwrotnego warunku przekazania osoby ściganej ENA przez niemieckie organy ścigania był fakt, iż w większości przypadków osoby te posiadały podwójne obywatelstwo.

Summary

This article presents a thorough analysis of the international law on legal assistance in criminal matters, as well as the reasons and effects of two amendments, made because of the need of implementation of the framework decision on the European Arrest Warrant. The author presents the reasons and consequences of the judgment of the Federal Constitutional Court, using the example of German citizens given away to other EU Member States.

The author offers a practical look at the reasons for the refusal to execute the European Arrest Warrant from the side of German regulations and their interpretation in practice, e.g., explaining that the reason for the refusal to implement the condition of giving away a person wanted by the European Arrest Warrant and by the German enforcement authorities was the fact that, in most cases these people had dual citizenship.
